SECTION 1 – DMCA NOTICE & TAKEDOWN PROCEDURE

1. INTRODUCTION

Aureon Music Group ("Aureon", "we", "our", or "us") respects the intellectual property rights of artists, creators, copyright owners, licensors, publishers, and other rights holders.

This Digital Millennium Copyright Act ("DMCA") Policy explains how Aureon responds to copyright infringement notices submitted under the United States Digital Millennium Copyright Act, 17 U.S.C. § 512.

Although Aureon is headquartered in the Republic of Ireland, we may receive DMCA notices relating to content accessible within the United States or hosted using service providers that operate under the DMCA framework.

This Policy supplements, and should be read together with, Aureon's:

Copyright Policy;

Terms of Use;

Commercial Licensing Agreement;

Creator Licence Agreement;

Privacy Policy;

Other applicable legal documents.

2. PURPOSE OF THIS POLICY

The purpose of this DMCA Policy is to:

Explain Aureon's DMCA notice-and-takedown procedure;

Provide a process for copyright owners to report alleged infringement;

Protect the rights of copyright owners;

Provide users with an opportunity to respond to allegations where appropriate;

Support compliance with applicable United States copyright law.

Nothing in this Policy limits Aureon's rights under other applicable copyright laws or international treaties.

3. WHO MAY SUBMIT A DMCA NOTICE

A DMCA notice may be submitted by:

The copyright owner;

An authorised legal representative;

An authorised licensing agent;

A publisher;

A record label;

A collecting society acting within its authority;

Another person authorised to act on behalf of the copyright owner.

Aureon may request evidence confirming that the person submitting the notice has authority to act.

4. GOOD FAITH REQUIREMENT

Any person submitting a DMCA notice must have a good faith belief that:

The use of the material has not been authorised by the copyright owner, its agent, or the law; and

The information contained in the notice is accurate.

Knowingly submitting false or misleading DMCA notices may expose the sender to liability under 17 U.S.C. § 512(f) and other applicable laws.

5. REQUIRED INFORMATION FOR A VALID DMCA NOTICE

To enable Aureon to process a DMCA notice efficiently, the notice should include:

The full legal name of the complainant;

Company or organisation (if applicable);

Postal address;

Telephone number;

Email address;

Identification of the copyrighted work claimed to have been infringed;

Identification of the allegedly infringing material, including the URL or other information reasonably sufficient to locate it;

A statement that the complainant has a good faith belief that the use is unauthorised;

A statement that the information in the notice is accurate and, under penalty of perjury, that the complainant is authorised to act on behalf of the copyright owner;

The physical or electronic signature of the copyright owner or authorised representative.

Incomplete notices may delay Aureon's investigation.

6. DESIGNATED DMCA CONTACT

DMCA notices should be submitted to Aureon's designated copyright contact using the details published on the Platform.

At launch, notices may be sent to:

DMCA Agent / Copyright Teaminfo@aureonmusic.com

or

Legal Departmentinfo@aureonmusic.com

Aureon may update its designated DMCA contact details from time to time.

Where required by applicable U.S. law, Aureon may register or update a designated DMCA agent with the United States Copyright Office.

7. ACKNOWLEDGEMENT OF RECEIPT

Where reasonably practicable, Aureon will acknowledge receipt of a DMCA notice within a reasonable time.

Acknowledgement does not mean that:

The notice is legally valid;

Copyright infringement has been established;

The material will necessarily be removed.

Each notice is assessed individually.

8. REVIEW OF THE NOTICE

Upon receiving a DMCA notice, Aureon may:

Review the information provided;

Verify the identity or authority of the complainant;

Review applicable licence records;

Request additional information;

Seek legal advice where appropriate;

Contact the user responsible for the material.

Aureon may decline to act where a notice is incomplete, manifestly unfounded, fraudulent, or otherwise legally deficient.

9. TEMPORARY REMOVAL OR DISABLING OF ACCESS

Where Aureon reasonably believes that a valid DMCA notice has been received, Aureon may:

Remove the allegedly infringing material;

Disable access to the material;

Restrict downloads;

Suspend distribution;

Restrict monetisation;

Take other temporary measures reasonably necessary to protect copyright.

Such action is administrative in nature and does not constitute a legal determination of infringement.

10. NOTIFICATION OF THE USER

Where appropriate, Aureon may notify the user whose material has been removed or disabled.

The notification may include:

Information regarding the DMCA notice;

Identification of the affected material;

Information regarding the counter-notification process;

Any actions taken by Aureon.

Certain information may be withheld where required by law or where disclosure could compromise an investigation.

11. REPEAT INFRINGERS

Users who repeatedly infringe copyright may be subject to Aureon's Repeat Infringer Policy.

Depending on the circumstances, Aureon may:

Issue warnings;

Restrict Platform access;

Suspend accounts;

Terminate subscriptions or licences;

Permanently terminate user accounts.

Repeat infringer decisions are made after considering the seriousness, frequency, and circumstances of the alleged infringements.

Further information is available in Aureon's Copyright Policy.

12. FRAUDULENT OR ABUSIVE NOTICES

Aureon will not tolerate abuse of the DMCA process.

Examples include:

Knowingly false notices;

Bad faith copyright claims;

Misrepresentation of copyright ownership;

Attempts to suppress lawful competition;

Abuse intended to harass another user.

Aureon reserves the right to reject abusive notices and to take appropriate legal or contractual action where permitted by applicable law.

13. RECORD RETENTION

Aureon may retain records relating to DMCA notices, including:

Notices received;

Supporting documentation;

Correspondence;

Internal investigation records;

Actions taken;

Counter-notifications;

Restoration decisions.

Such records are retained in accordance with Aureon's Privacy Policy and applicable legal obligations.

14. INTERNATIONAL COPYRIGHT CLAIMS

This DMCA Policy applies specifically to notices submitted under the United States DMCA.

Copyright owners outside the United States may alternatively rely on:

Aureon's Copyright Policy;

Applicable national copyright legislation;

International copyright treaties;

Other legal remedies available in their jurisdiction.

Nothing in this Policy limits Aureon's ability to investigate or respond to copyright complaints submitted outside the DMCA framework.

15. OUR COMMITMENT TO COPYRIGHT COMPLIANCE

DMCA POLICY

SECTION 2 – COUNTER-NOTIFICATION PROCEDURE

16. OVERVIEW

Aureon Music Group recognises that copyright complaints may occasionally be submitted in error or may involve disputes regarding ownership, licensing, fair use, or other legal rights.

Where content has been removed or access has been disabled following receipt of a DMCA notice, the affected user may have the opportunity to submit a counter-notification in accordance with the United States Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512(g).

This Section explains Aureon's counter-notification process.

17. WHO MAY SUBMIT A COUNTER-NOTIFICATION

A counter-notification may be submitted by:

The user whose content was removed or disabled;

The lawful owner of the affected Aureon Account;

An authorised legal representative acting on behalf of the affected user.

Aureon may request reasonable evidence confirming the identity or authority of the person submitting the counter-notification.

18. WHEN A COUNTER-NOTIFICATION MAY BE SUBMITTED

A counter-notification may be appropriate where the affected user believes, in good faith, that:

The material was removed due to mistake or misidentification;

The use of the material was authorised by the copyright owner;

The user holds a valid licence permitting the use;

The material is not infringing;

The removal resulted from an administrative or technical error;

Another valid legal defence applies under applicable law.

Submission of a counter-notification does not guarantee that the material will be restored.

19. REQUIRED INFORMATION

To assist Aureon in processing a counter-notification, the submission should include:

The user's full legal name;

Company or organisation (if applicable);

Postal address;

Telephone number;

Email address;

Identification of the removed or disabled material;

The location of the material before removal, including the URL where available;

A statement, made under penalty of perjury, that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;

A statement consenting, where applicable under the DMCA, to the jurisdiction of the appropriate United States Federal District Court (or, if outside the United States, to a court specified under the DMCA framework), and agreeing to accept service of process from the original complainant or their authorised representative;

The user's physical or electronic signature.

Incomplete counter-notifications may delay or prevent Aureon's review.

20. SUBMISSION OF COUNTER-NOTIFICATIONS

Counter-notifications should be submitted to Aureon's designated DMCA contact.

At launch, submissions may be sent to:

DMCA Agent / Copyright Teaminfo@aureonmusic.com

or

Legal Departmentinfo@aureonmusic.com

Aureon may update these contact details from time to time.

21. REVIEW OF COUNTER-NOTIFICATIONS

Upon receipt of a counter-notification, Aureon may:

Review the information provided;

Verify the identity of the submitting party;

Review applicable licence records;

Request additional information;

Seek independent legal advice where appropriate;

Assess whether the counter-notification substantially complies with applicable legal requirements.

Aureon may reject counter-notifications that are incomplete, fraudulent, abusive, or otherwise legally deficient.

22. FORWARDING TO THE ORIGINAL COMPLAINANT

Where appropriate under the DMCA process, Aureon may forward the counter-notification, in whole or in part, to the original complainant or their authorised representative.

This enables the complainant to determine whether they intend to commence legal proceedings regarding the disputed material.

Personal information will be handled in accordance with Aureon's Privacy Policy and applicable law.

23. RESTORATION OF CONTENT

Where the applicable requirements of the DMCA are satisfied and Aureon does not receive timely notice that the complainant has commenced legal proceedings seeking to restrain the allegedly infringing activity, Aureon may restore access to the material in accordance with applicable law.

Restoration of content:

Does not constitute a finding that the material is lawful;

Does not determine copyright ownership;

Does not prevent future copyright claims relating to the same material.

24. LEGAL PROCEEDINGS

If Aureon receives notice that the complainant has commenced legal proceedings seeking to restrain the allegedly infringing activity, Aureon may:

Continue to disable access to the material;

Maintain account restrictions where appropriate;

Comply with applicable court orders;

Take any other action required or permitted by law.

Aureon does not adjudicate copyright disputes and will comply with binding legal decisions made by courts or other competent authorities.

25. FALSE OR FRAUDULENT COUNTER-NOTIFICATIONS

Submitting a knowingly false or misleading counter-notification may expose the submitting party to liability under 17 U.S.C. § 512(f) and other applicable laws.

Aureon reserves the right to:

Reject fraudulent counter-notifications;

Suspend or terminate user accounts where appropriate;

Refer suspected fraudulent conduct to relevant authorities where required or permitted by law;

Pursue other contractual or legal remedies.

26. REPEAT COUNTER-NOTIFICATIONS

Repeated submission of counter-notifications that are:

Fraudulent;

Abusive;

Manifestly unfounded;

Intended to delay enforcement actions;

may result in additional investigation and enforcement measures, including account suspension or termination.

27. RECORD RETENTION

Aureon may retain records relating to counter-notifications, including:

Counter-notices received;

Supporting documentation;

Correspondence;

Internal investigation records;

Decisions made;

Restoration actions;

Related legal documentation.

Records are retained in accordance with Aureon's Privacy Policy and applicable legal obligations.

28. INTERNATIONAL USERS

The counter-notification process described in this Section is intended primarily to comply with the United States DMCA.

Users outside the United States may also have rights under:

National copyright legislation;

Local court procedures;

International copyright treaties;

Other applicable legal frameworks.

Nothing in this Policy limits any rights available under applicable law outside the United States.

29. NO LEGAL DETERMINATION

Aureon's review of a counter-notification is an administrative process designed to manage the Platform responsibly.

Aureon's decision to restore, retain, or continue restricting access to material:

Does not constitute legal advice;

Does not determine copyright ownership;

Does not determine whether infringement has occurred.

Only a court or other competent legal authority can make a final determination regarding copyright disputes.

30. GOOD FAITH PARTICIPATION

Aureon expects all participants in the DMCA process to act honestly and in good faith.

Both copyright notices and counter-notifications should be submitted only where the submitting party genuinely believes that their legal position is correct.

The misuse of either process undermines the protection of creators and the fair operation of the Platform.

31. OUR COMMITMENT TO FAIR PROCESS

Aureon Music Group is committed to administering the DMCA counter-notification process fairly, impartially, and transparently.

Our objectives are to:

Protect the rights of copyright owners;

Respect the legal rights of users;

Encourage responsible use of the DMCA process;

Reduce the risk of wrongful removals;

Support lawful dispute resolution;

Maintain a trusted and legally compliant music platform.

We encourage all parties to resolve copyright disputes professionally, respectfully, and in accordance with applicable law.
